Official Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.
1. Sponsor
The SwipeKana Quarterly Japan Trip Sweepstakes (the "Sweepstakes") is sponsored by SwipeKana LTD, with its principal place of business at 20 Wenlock Road, London, N1 7GU, United Kingdom (the "Sponsor").
2. Eligibility
The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry. Void outside the United States and where prohibited by law. The following persons are NOT eligible to participate: • Employees, officers, directors, and agents of the Sponsor and its parent companies, subsidiaries, and affiliates; • Members of the immediate family (defined as spouse, parent, child, sibling, grandparent, grandchild, and their respective spouses, regardless of where they reside) of any of the foregoing persons; • Persons residing in the same household as any of the foregoing persons, whether or not related. Participation constitutes the entrant's full and unconditional agreement to these Official Rules and to the Sponsor's decisions, which are final and binding in all matters relating to the Sweepstakes. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations.
3. Sweepstakes Period
The Sweepstakes is conducted on a recurring quarterly basis. Each quarterly period (a "Quarter" or "Sweepstakes Period") begins at 12:00:00 a.m. Eastern Time ("ET") on the first day of each calendar quarter and ends at 11:59:59 p.m. ET on the last day of that calendar quarter: Q2: May 1 2026 – August 1 2026 The first Sweepstakes Period begins on May 1st 2026. The Sponsor's server is the official timekeeping device for the Sweepstakes. The Sponsor intends to conduct the Sweepstakes on an ongoing quarterly basis but is under no obligation to do so. The Sponsor may modify, suspend, or discontinue the Sweepstakes or any Sweepstakes Period at any time, for any reason, with reasonable notice to participants where practicable. All Entries earned during an active Sweepstakes Period will remain valid for the drawing of that Period unless otherwise stated.
4. How to Enter
There are two (2) methods of entry: App-Based Entry (Section 4A) and Free Alternate Method of Entry / AMOE (Section 4B). Both methods provide an equal chance of winning on a per-Entry basis. No method of entry is superior to any other on a per-Entry basis.
4A. App-Based Entry (No Purchase Required)
Download the SwipeKana mobile application (the "App"), available free of charge from the Apple App Store. Create a free account by providing a valid email address. Entries ("Entries") are earned automatically through the following in-app activities: Learning Activities: • Complete a lesson: 5 Entries (free users) / 15 Entries (subscribers) • Achieve a 7-day streak: 25 Entries (free) / 75 Entries (subscribers) • Achieve a 30-day streak: 100 Entries (free) / 300 Entries (subscribers) • Achieve a 90-day streak (full quarter): 500 Entries (free) / 1,500 Entries (subscribers) • Level up: 50 Entries (free) / 150 Entries (subscribers) Free users are limited to 2 lessons per day. Subscribers have access to unlimited daily lessons. See Section 5 for subscription disclosure. Public Posting Activities (equal for all users): • Post about SwipeKana on a supported social media platform (TikTok, Instagram, YouTube, X/Twitter): 200 Entries per verified post, limit 5 posts per calendar week • Verified post achieves 1,000+ views: +100 bonus Entries (no limit) • Verified post achieves 5,000+ views: +250 bonus Entries (no limit) Personal Sharing Activities (equal for all users): • Share via tracked referral link: 10 Entries per share, limit 10 per day • A new user clicks your referral link: +15 Entries (no limit) • A referred user downloads the App: +50 Entries (no limit) • A referred user achieves a 7-day streak: +100 Entries (no limit) Viral Bonus Tiers (equal for all users; tiers are cumulative): • A single verified post reaches 10,000 views: +2,500 Entries • 50,000 views: +10,000 Entries • 100,000 views: +25,000 Entries • 250,000 views: +60,000 Entries • 500,000 views: +150,000 Entries • 1,000,000 views: +400,000 Entries • 5,000,000 views: +2,000,000 Entries Viral bonus tiers are cumulative. A post reaching 100,000 views earns the 10,000-view tier bonus, the 50,000-view tier bonus, AND the 100,000-view tier bonus. There is no limit on the number of posts that may earn viral bonuses. Entry Integrity: All Entries must be earned through legitimate participation. Entries generated by script, macro, bot, or other automated means are void. The Sponsor reserves the right to disqualify any entrant who it reasonably believes has attempted to manipulate view counts, referral activity, or Entry accumulation through fraudulent or deceptive means. The Sponsor's determination of fraud shall be final. All Entries reset to zero at the start of each new Sweepstakes Period.
4B. Free Alternate Method of Entry (AMOE)
NO PURCHASE, DOWNLOAD, OR APP USAGE IS NECESSARY TO ENTER OR WIN. To enter without using the App, visit swipekana.com/sweepstakes during the Sweepstakes Period and complete the free online entry form by providing your full legal name, valid email address, date of birth, and state of residence. Each AMOE submission grants the entrant one hundred (100) Entries. AMOE submissions are limited to one (1) per person per calendar week during the Sweepstakes Period (maximum thirteen (13) submissions per Quarter, for a total of 1,300 Entries). The Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected AMOE submissions, which will be disqualified. The authorised account holder of the email address submitted will be deemed to be the entrant.
5. Subscription Disclosure
The App offers an optional paid subscription at $9.97 USD per month (or such other price as may be in effect at the time of purchase). Subscribers receive enhanced in-app features including unlimited daily lessons and a 3x multiplier on learning-activity Entries only. A subscription is NOT required to enter or win the Sweepstakes. Free users may earn Entries through all methods described in Section 4A (subject to the daily lesson limit for learning activities) and through the AMOE described in Section 4B. Public posting Entries, personal sharing Entries, and viral bonus Entries are identical for free users and subscribers. A purchase does not improve the chances of winning on a per-Entry basis.
6. Drawing and Winner Selection
On or about the fifth (5th) business day following the end of each Sweepstakes Period, the Sponsor will conduct a random drawing from among all eligible Entries received during that Sweepstakes Period. The drawing will use a computerised random selection method, where each Entry represents one (1) equal chance to win. The more Entries a participant accumulates, the greater their statistical probability of being selected; however, the winner is ultimately determined by random chance. This is a sweepstakes, not a contest of skill. One (1) potential winner will be selected per Sweepstakes Period. The potential winner will be notified by email at the address associated with their account or AMOE submission. The potential winner must respond to the notification within seven (7) calendar days. If the potential winner does not respond, or if the notification is returned as undeliverable, the prize will be forfeited and an alternate potential winner may be selected from the remaining eligible Entries. Up to three (3) alternate drawings may be conducted. If no eligible winner is confirmed after three (3) alternate drawings, the prize for that Sweepstakes Period will not be awarded.
6A. Minimum Participation Threshold and Prize Rollover
A minimum of one thousand (1,000) unique eligible entrants must have earned or received at least one (1) Entry during a Sweepstakes Period for the drawing to take place. If this threshold is not met: • No drawing will be conducted for that Sweepstakes Period; • The prize will roll over to the following Sweepstakes Period. The rolled-over prize will be of the same approximate retail value ($4,999 USD) unless the Sponsor, at its sole discretion, elects to increase the prize value; • All Entries from the period that did not meet the threshold will be voided and will NOT carry over. All participants start at zero Entries in the new Quarter; • Participants will be notified via email and/or in-app notification that the drawing has been deferred. If the minimum participation threshold is not met for two (2) consecutive Sweepstakes Periods, the Sponsor reserves the right to restructure the prize, modify the threshold, or discontinue the Sweepstakes with reasonable notice.
7. Prize
One (1) prize will be awarded per Sweepstakes Period (subject to Section 6A), consisting of: • Round-trip economy-class airfare from the winner's nearest major US airport to a major airport in Japan (Tokyo Narita or Tokyo Haneda, at the Sponsor's discretion); • Hotel accommodation for seven (7) nights at a standard hotel selected by the Sponsor; • A spending stipend of five hundred US dollars ($500 USD). Approximate Retail Value ("ARV"): $4,999 USD. Actual value may vary depending on the winner's point of departure, travel dates, and availability. Any difference between the stated ARV and the actual value will not be awarded in any form. The prize is non-transferable, non-exchangeable, and may not be redeemed for cash unless the Sponsor, at its sole discretion, offers a cash alternative. The Sponsor reserves the right to substitute a prize of equal or greater value if the stated prize becomes unavailable for any reason. Travel must be completed within twelve (12) months of the winner notification date. The winner is solely responsible for obtaining all required travel documents, including a valid passport and any necessary visas. If the winner is unable or unwilling to travel for any reason, the prize will be forfeited and an alternate winner may be selected. Note: Because the per-Quarter ARV of $4,999 USD is below $5,000, the Sponsor is not required to register or bond the Sweepstakes in New York, Florida, or Rhode Island under current state law.
8. Taxes
The winner is solely responsible for all applicable federal, state, and local taxes arising from the acceptance and use of the prize. All federal, state, and local laws and regulations apply. If the ARV of the prize equals or exceeds $2,000 USD, the Sponsor is required to report the prize value to the Internal Revenue Service (IRS). The winner will be required to provide a completed IRS Form W-9 (Request for Taxpayer Identification Number and Certification) before the prize is fulfilled. The Sponsor will issue IRS Form 1099-MISC for the applicable tax year as required by law. Failure to provide a completed W-9 within fourteen (14) calendar days of notification will result in forfeiture of the prize.
9. Winner Verification and Requirements
Before being confirmed as the winner, the potential winner will be required to: • Provide proof of identity and eligibility (valid US government-issued photo identification, proof of age, proof of US residency); • Complete, sign, and return an Affidavit of Eligibility and Liability Release, and (where permitted by law) a Publicity Release, within fourteen (14) calendar days of notification; • Provide a completed IRS Form W-9 as described in Section 8; • Confirm that they hold a valid US passport or can obtain one within a reasonable timeframe prior to travel. Failure to comply with any of the foregoing requirements within the specified timeframes, or the return of any notification as undeliverable, will result in forfeiture of the prize, and an alternate winner may be selected.
10. Publicity
Except where prohibited by law, acceptance of the prize constitutes the winner's consent for the Sponsor to use the winner's first name, last initial, city and state of residence, likeness, photograph, video, statements, and voice for promotional, advertising, and publicity purposes in any media (including social media), worldwide, in perpetuity, without additional compensation or notice. The Sponsor may request that the winner participate in promotional activities related to the prize trip, including a reaction video, photographs from the trip, or social media posts about the experience. Such participation is encouraged but is not a condition of receiving the prize.
11. Limitation of Liability
To the fullest extent permitted by applicable law, by entering the Sweepstakes, each entrant agrees to release, discharge, indemnify, and hold harmless the Sponsor and its officers, directors, employees, agents, successors, and assigns (collectively, the "Released Parties") from and against any and all claims, damages, losses, costs, expenses, and liability (including reasonable attorneys' fees) arising out of or relating to: • Participation in the Sweepstakes or any Sweepstakes-related activity; • Acceptance, possession, use, or misuse of any prize; • Travel to, from, or during the prize trip, including but not limited to personal injury, death, property damage, or loss; • Any technical failures, errors, omissions, interruptions, or delays in the Sweepstakes, the App, or any Sweepstakes-related website; • Any unauthorised access to, or theft, destruction, or alteration of, entries or personal data at any point in the operation of the Sweepstakes. THE PRIZE IS AWARDED "AS IS" WITH NO WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
12. General Conditions
The Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes (or any Sweepstakes Period) if a virus, bug, unauthorised human intervention, fraud, technical failure, or any other factor beyond the Sponsor's reasonable control impairs the integrity or proper functioning of the Sweepstakes. The Sponsor reserves the right to disqualify any entrant who tampers with the entry process, the operation of the Sweepstakes, or the App, or who violates these Official Rules or acts in an unsportsmanlike or disruptive manner. Any attempt to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law; the Sponsor reserves the right to seek remedies to the fullest extent of the law. The authorised account holder of the email address used to enter will be deemed to be the entrant. The "authorised account holder" is the natural person assigned an email address by an Internet access provider, online service provider, or other organisation responsible for assigning email addresses for the domain associated with the submitted address. A potential winner may be required to show proof of being the authorised account holder. Entries that are incomplete, illegible, corrupted, or submitted by means not authorised by these Official Rules are void.
13. Social Media Disclaimer
This Sweepstakes is in no way sponsored, endorsed, administered by, or associated with TikTok, Instagram (Meta Platforms, Inc.), YouTube (Google LLC), X Corp., Apple Inc., Google LLC, or any other third-party platform or app store. All questions, comments, or complaints regarding the Sweepstakes should be directed to the Sponsor, not to any third-party platform. Entrants who earn Entries through public posting or sharing activities must comply with all applicable platform terms of service and community guidelines. The Sponsor is not responsible for any action taken by a third-party platform against an entrant's account. Apple Inc. is not a sponsor of, and is not involved in any way with, this Sweepstakes.
14. Privacy
By entering the Sweepstakes, entrants consent to the collection, processing, and storage of their personal data by the Sponsor for the purposes of administering the Sweepstakes, including entry tracking, winner selection, winner notification, prize fulfilment, and tax reporting. The Sponsor will process personal data in accordance with its Privacy Policy, available at swipekana.com/privacy. Personal data collected may include: name, email address, date of birth, state of residence, App usage data relating to Entry accumulation, social media handles, referral activity, and (for the winner) postal address, government identification, and tax identification number (SSN/TIN via W-9). The Sponsor will not sell entrants' personal data to third parties. Personal data may be shared with third-party service providers solely for the purpose of administering the Sweepstakes (e.g., travel booking agents, email service providers). All personal data related to the Sweepstakes will be retained for a minimum of four (4) years following the end of each Sweepstakes Period, or longer if required by law for tax reporting, after which it will be securely deleted. For California residents: Under the California Consumer Privacy Act (CCPA/CPRA), California residents have additional rights regarding personal information, including the right to know, delete, and opt out of the sale of personal information. 15. Dispute Resolution and Governing Law
These Official Rules and any disputes arising out of or in connection with the Sweepstakes shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any dispute, claim, or controversy arising out of or relating to the Sweepstakes that cannot be resolved by informal negotiation within thirty (30) days shall be submitted to binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules then in effect. The arbitration shall be conducted by a single arbitrator. The language of the arbitration shall be English. The decision of the arbitrator shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, entrants agree that: (a) any and all disputes and claims shall be resolved individually, without resort to any form of class action; (b) any claims shall be brought in the entrant's individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding; and (c) the arbitrator may not consolidate more than one person's claims, and may not preside over any form of representative or class proceeding.
16. Odds of Winning
The odds of winning depend on the total number of eligible Entries received during the applicable Sweepstakes Period. Each Entry represents one equal chance of being selected in the random drawing. Because the total number of eligible Entries will vary each Quarter, the odds cannot be determined in advance.
17. Winner List
For the name of the winner of any completed Sweepstakes Period, send an email with the subject line "SwipeKana Sweepstakes Winner List – [Quarter, e.g., Q1 2026]" to hello@swipekana.com within ninety (90) days after the end of the applicable Sweepstakes Period. The winner's first name, last initial, and city/state of residence will be provided.
18. Severability
If any provision of these Official Rules is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the original intent of the parties.
19. Entire Agreement
These Official Rules constitute the entire agreement between the entrant and the Sponsor with respect to the Sweepstakes and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
